Yamaha Asks Supreme Court to Rule on Whether Buckman Co. v. Plaintiffs’ Legal Committee Renders Plaintiff’s Claim of Wanton Disregard Preempted

Yamaha argues that plaintiff’s claim is preempted because it is based on Yamaha’s conduct before the U.S. Consumer Product Safety Commission and only the U.S. Consumer Product Safety Commission has authority over Yamaha’s conduct before it.  Yamaha argued that there is a growing split in how Buckman is being applied by lower courts.  A copy of the Buckman opinion can be found here.
