Supreme Court To Determine If Attorney Sanctions Must Be Tailored To Harm Actually Caused

The U.S. Supreme Court has agreed to decide whether sanctions imposed in a civil case must be tailored to the harm actually caused by the misconduct, in the absence of the protections of criminal due process.  The court has added to its docket for the upcoming term two consolidated cases arising from the imposition of $2.7 million in sanctions against Goodyear Tire Co. and its counsel – an amount Goodyear says is roughly equal to the total attorney fees incurred in the litigation.
