Summary Judgment in Favor of Chrysler in “False Park” Suit Reversed By Ninth Circuit

The U.S. Court of Appeals for the Ninth Circuit reversed a district court’s grant of summary judgment in favor of Chrysler Group, LLC on the grounds that fact issues existed as to whether the deaths of an elderly couple were the result of a “false park” defect in a Chrysler Grand Caravan. The defect allowed the gear shift selector to be placed in a position between “park” and “reverse” so that the vehicle could appear to be in “park” but could engage the transmission in reverse.  The plaintiffs claim that the defect allowed the van to self-shift into reverse.
