
Sixth Circuit Upholds Class Certification in Probiotic Advertising Row
The U.S. Court of Appeals for the Sixth Circuit has upheld certification for five single-state class actions against The Proctor & Gamble Company involving their probiotic nutritional supplement Align. The plaintiffs claim the P&G violated various state unfair or deceptive practice statutes by promoting Align as promoting digestive health despite, plaintiffs claim, the lack of any scientific evidence that the product works as advertised.
