Seventh Circuit Rejects Heightened Class Ascertainability Standard

The U.S. Court of Appeals for the Seventh Circuit’s July 28 ruling in Mullins v. Direct Digital LLC established a circuit split with the Third Circuit as to evidentiary standard to be applied to plaintiff’s efforts to identify class members at the certification stage of consumer class litigation.
