Pennsylvania’s Nuisance and Trespass Claims Against Oil Companies Dismissed in MBTE Groundwater Contamination Case

Judge Shira Scheindlin of the U.S. District Court for the Southern District of New York dismissed the Commonwealth of Pennsylvania’s public nuisance and trespass claims against Atlantic Richfield Co., ExxonMobil Corp. and 44 other oil companies in the MDL case concerning the contamination of ground water with the gasoline additive methyl tertiary butyl ether (MTBE).  The ruling did not dismiss the Commonwealth’s claims under the Pennsylvania Unfair Trade Practices and Consumer Protection Law.
