Organic Milk Claims Dismissed

Judge Jon S. Tigar of the U.S. District Court for the Northern District of California dismissed a proposed class action claiming that the addition of DHA -- an omega-3 fatty acid -- to Danone North America's Horizon Organic milk rendered the milk's organic label misleading.  Judge Tigar held that the federal Organic Foods Production Act preempted the claims, and also held that the plaintiff lacked standing because the label prominently disclosed the presence of DHA.  [5/4/18]
