“No Trans Fat” Mislabeling Not Preempted

Judge Alison J. Nathan of the U.S. District Court for the Southern District of New York sided with the Ninth Circuit rather than the Third Circuit in holding that federal labeling regulations do not preempt claims that the labels on Johnson & Johnson’ Benecol Spread claiming “no trans fats” are misleading because the spread contains partially hydrogenated soybean oil, which contains trans fats.
