Court Revives Claims of Food Worker Who Hand Was Yanked into Meat Grinder

The U.S. Court of Appeals for the Ninth Circuit reversed a trial court’s grant of summary judgment in favor of the manufacturer of a food grinder that allegedly yanked a food worker’s hand into the grinder’s moving blade when she opened the grinder’s lid. The court held that the food worker’s testimony was sufficient to establish causation, and that the manufacturer failed to meet its burden to prove a lack of feasible safety devices or to show that lifting the grinder’s lid was not foreseeable misuse.
