Federal Circuit Affirms Willful Infringement Against W.L. Gore

This week, the Federal Circuit denied Gore’s request for an en banc rehearing of its long running patent litigation against C.R. Bard over stent graft technology. The judgment against Gore is near $1.1 billion, and includes approximately $200 million in damages on willfulness findings. Gore alleged that one of its own engineers was the inventor of one of the key patent claims. [4/13/15]
