DuPont MSJ Denied in Drinking Water Contamination MDL

Judge Edmund A. Sargus of the U.S. District Court for the  Southern District of Ohio has denied DuPont Co.’s motion for summary judgment in connection with two upcoming bellwether trials in multidistrict contaminated drinking water litigation.  DuPont had argued that the plaintiffs in the two cases hadn’t shown that their illnesses were “specifically caused” by ammonium perfluorooctanoate (C-8) from a DuPont plant in West Virginia in their drinking water, and said that other causes of their illnesses were more likely.  Judge Sargus disagreed, finding that the plaintiffs had submitted sufficient evidence to create a jury question.
