Drugmakers Win Summary Judgment on Learned Intermediary Doctrine Despite Providing Consumer Safety Information

Judge John E. Steele of the U.S. District Court for the Middle District of Florida granted summary judgment to Amgen, Inc., Wyeth, Inc. and Pfizer Inc., in a product liability suit over the rheumatoid arthritis treatment, Enbrel. The court held that the learned intermediary doctrine barred plaintiff’s claims, even if the drug makers provided safety information directly to consumers in accord with U.S. Food and Drug Administration regulations.
