Dannon “Natural” Yogurt Mislabeling Case Dismissed

Judge Katherine B. Forrest of the U.S. District Court for the Southern District of New York has dismissed a putative class action alleging that Dannon Company, Inc. deceived consumers by labeling its yogurt as "natural" although the cows that produced the milk used in making the yogurt may have consumed GMO feed.  Judge Forrest noted that the FDA's current guidance defines "natural" as meaning nothing artificial or synthetic had been added to the product, and that Dannon's yogurt fit that definition.  Judge Forrest also chided the plaintiff for offering conclusory allegations based on her own feelings and assumptions.  [12/5/17]
