Court Upholds Class Certification in Wyeth Hormone Replacement Therapy Consumer Class Action

Judge John A. Houston of the U.S. District Court for the Southern District of California upheld class certification in a suit brought under the California Consumers Legal Remedies Act and Unfair Competition Law by women who allege that Wyeth Inc. and Wyeth Pharmaceuticals Inc. deceptively promoted their Premarin, Prempro, and Premphase hormone replacement therapy drugs for non-approved, off-label uses including the prevention of cardiovascular disease and dementia while downplaying the risk of breast cancer.  The case’s primary issue is “the allegedly overriding, material misrepresentation that defendants' HRT products lower a woman's risk of cardiovascular disease, dementia, and Alzheimers disease, without increasing breast cancer risk,” Judge Houston held.
