Court Stays General Mills Trans Fat Case Pending FDA “Additive” Determination

U.S. District Judge Thelton E. Henderson of the U.S. District Court for the Northern District of California stayed a proposed class action over trans fats in General Mills, Inc.’s baking mixes pending a determination by the U.S. Food and Drug Administration whether small amounts of trans fats may lawfully be used as a food additive. The suit alleges that General Mills violated state and federal law by using partially hydrogenated oils containing trans fats; the plaintiff had objected to the stay request by arguing that the FDA had already decided this issue by removing its “generally recognized as safe” designation for trans fats in June.
