Preemption Dooms “Maple & Brown Sugar” Oatmeal Mislabeling Class Actions

Judge Philip S. Gutierrez of the U.S. District Court for the Central District of California has dismissed consolidated class actions alleging that the labeling and packaging of Quaker Oats Company's Maple & Brown Sugar instant oatmeal is false and misleading because the product does not contain maple syrup.  Judge Gutierrez held that the federal Food, Drug and Cosmetics Act and the Nutritional Labeling and Education Act preempted plaintiffs' claims.
