Cancer-causing Chemicals Proposition 65 to Curb Overwarnings

Recent legislation introduced in California intends to clarify the scientific evidence needed before an exposure warning is mandated by Proposition 65.  The bill (AB543) proposes an exposure assessment conducted by a qualified scientist to determine whether a business knowingly and intentionally exposes individuals to cancer-causing chemicals or reproductive toxicity.  Such a bill looks to curb what appears to be a current climate of over-warnings and may have an impact on business practices and decisions before and after a lawsuit is filed.
