California AG Harris Proposes Changes to Prop 65 Regulations to Curb Private Civil Action Abuse

California Attorney General Kamala Harris announced proposed changes to regulations implementing Proposition 65 – the law requiring businesses to provide warnings if they expose individuals to listed carcinogens or reproductive toxins – that would “stem abuse of the law’s mechanism to allow for enforcement by private parties” by capping so-called “in lieu of penalties” payments to litigants in private civil actions brought when governmental entities do not pursue violations.
