24 Hour Fitness Easily Side-steps Liability

Health clubs take heed: a properly executed and administered release form can prevent you from liability associated with defective exercise equipment.  That’s what the California Court of Appeals has ruled in a case involving 24 Hour Fitness.  24 Hour Fitness’s release form, which covered “ordinary negligence,” was sufficient to disclaim the company from any liability associated with an injury-causing rowing machine—because he signed the form, the club member had assumed the risk arising from using the gym’s facilities, services, equipment, or premises. [2/25/15]
